Terms of Service

1. INVOICES & PAYMENT
a. Invoices for design work will be issued on confirmation of the proposed work. Payments are required to be paid in full, prior to work commencement, unless an alternative method has been arranged with management.

b. Website hosting requires the package to be paid in full upfront prior to registration of the hosting service. An email payment request for the preferred payment method will be issued to the client post registration form completion, the client should follow the instructions in this email provided to complete the order. No service will be activated before payment is recieved in full. Delays of upto 6 hours with no guarantees of the period between submitting the registration form and recieving the payment request email. Once the payment is recieved in our nominated bank account, we will activate the new account and notify the client by email, including instructions on how to log into the hosting service for the first time.

c. On-site appointments exceeding 200km (return) travelling distance require down payment of the total travel fee, this is due and payable prior to technician departure.
2. CHARGING RATES
As of 26/11/2008, all charging rates for work undertaken are charged at: $50.00 per hour.

Special charging rates are available for eligible persons holding a current Australian Aged Pension card at  $30.00 per hour (discount valid for computer servicing & repairs only, does not apply to purchased goods or web related products and services).

Travel charges for on-site appointment: $0.50 per KM (minimum charge $25)

3. TITLE OF WORK
Each product is subject to individual titles as described here:
a. Any graphics designs and other images produced for website projects, remain the property of Hanley Designs, and thus may be used for future non-related projects.
b. Original photographs produced by 'Hanley Designs' are not to be reproduced or altered in any way without prior concent.
c. It is assumed and expected that any photographs supplied by clients for digital editing are those owned by the client. The client therefore reserving full rights to redistribute and alter those images on their own accord.
d. All websites produced by 'Hanley Designs' are tagged with a small link in the site footer, which directs to our website, it is a condition of these terms that this link remain affixed, unless an additional fee of $149.00 is paid for it to be removed. If the footer tag is removed without notification or concent, the fee will be invoiced and made payable to the client.
e. Original physical drawings produced by Hanley Designs are tagged with the Hanley signature, They may be resold at will, this also includes prints of original works produced by Hanley Designs.
f. Any work whether complete or incomplete, for whatever reason not used in any production or sale, remains the property of Hanley Designs, unless specifically purchased by the original client.

4. RESELLING FOR PROFIT
Reselling rights are explained per service titles as written throughout section 3 of these terms.

5. OVERDUE ACCOUNTS
No service shall be supplied to persons holding overdue accounts, until such time as the account is brought up to date. Hanley Designs reserves the right to maintain possession of any work produced or materials collected and are properties of the client, until their account is paid in full. In the event that an account is not paid in full and the client makes no attempt to complete payments by their due date/s, the client agrees to absorb all legal costs, interest, and damages incurred to recover any losses caused by the spoken debt. All attempts to recover unpaid accounts will be made, including debt collection services and legal proceedings.

6. QUOTATIONS
Hanley Designs offer a free quotation with every online work request, all quotes remain in-date and accountable for 10 days after the quote is distributed. After that time, another quote will be made valid. Quotes that are produced in person may incur a call-out fee if appropriate.

7. ALTERATIONS & ALLOCATIONS
a. After work has commenced, the client has 90 days to fill all page allocations and image gallery reservations, those not filled within this time will be forfeited. Alterations and inclusions requested after this time will be charged at additional cost.
b. After work is complete and client has approved the completed work. The client agrees to pay a fee, which is relative to the complexity of the alteration/s made, charged at the hourly rate.

8. CORRECTIONS & APPROVALS
Whilst we endeavour to ensure correctness, it is the responsibilty of the client to ensure that the content, layout and spelling are accurate. It is only with written authority from the client, that the work be approved, we do not accept verbal approvals.

9. CLAIMS
All claims regarding faulty workmanship must be addressed within 7 days of work completion, and prior to the submission of a written approval from the client.

10. COPYRIGHT & OWNERSHIP OF CONTENT PROVIDED
It is expected that all content supplied to Hanley Designs for the purpose of website construction is owned or has the appropriate permissions by its owner. We hold no responsibility for any use of unauthorised content provided by our clients. We shall not be held responsible for such content. If an issue arises, it should be dealt directly with the owner/operator of the website in question.

11. WORK COMPLETION TIME
An estimated completion time is given on quotation, this is an estimate only and should not be viewed as a definate time-span. Hanley Designs will not be held liable for work that takes longer than quoted to complete, including delays subjected by the client failing to provide adequate materials. It is the responsibility of the client to provide correct account login information for external hosted server control panels and domains, we will not accept responsibility for delays due to lack of account information.

12. DOMAIN REGISTRATION
We cannot and do not guarantee the availability of any domain name, it is important to check the availability of your preferred domain name before requesting it in our Registration forms. Although we will try our best to reserve your domain name for your order, on the odd occasion it may already be registered or cannot be registered. When ordering your domain names on Hanley Designs, there may be a delay in the time your domain is paid for and then registered, normally within 6 hours of the same day. If a domain name is not available at the time of account activation, we will notify the client and suggest alternatives, or request a revised domain name from the client. 

13. WEBSITE HOSTING
Hanley Designs offer various hosting packages to our clients, and we offer full support for these services at no extra charge. Some server limitations may prevent functionality restrictions of your website, such as our servers do not support in-server FLV video conversion on the fly, so please request further information if you have any questions.
 

14. HANLEY DESIGNS HOSTING DIRECTORY
By default, all hosted accounts are included in our unique hosting directory. Account holders may opt out of this listing at any time without charge, however we recommend the continued usage of the Hanley Designs Hosting Directory as it can assist in overall search engine rankings and placement of the websites listed, additional hits delivered to those sites directly from the listing will often result.

We reserve the right to alter the conditions of these terms without warning or advise.
